Terms and Conditions (T&Cs) – Alpina Sanico
1. Scope of Application & Contractual Partners
These Terms and Conditions apply to the rental of accommodation units located at Via Sanico 47, 25088 Toscolano Maderno (BS), Italy. Depending on the specific unit booked, the accommodation contract is concluded with the respective landlord:
For the apartments “Pizzocolo” and “Maderno”: Björn Balkenhol, Harkortweg 4, 58332 Schwelm, Germany. CIN: [Placeholder] / CIR: [Placeholder]
For the rooms “Sanico” and “Ortello”: Jasmin Balkenhol, Via Sanico 47, 25088 Toscolano Maderno (BS), Italy.

The technical and administrative processing of all bookings is managed centrally through the unified management system Smoobu.
2. Booking, Conclusion of Contract & Right of Withdrawal
The contract is deemed concluded as soon as the accommodation is bindingly reserved and the booking has been confirmed by the respective landlord in writing or via a system message. By completing a booking, the guest accepts these Terms and Conditions as well as the House Rules. Notice regarding the right of withdrawal: Please note that for contracts concerning the provision of services related to accommodation for a specific date or period, there is no statutory right of withdrawal for consumers (pursuant to § 312g para. 2 no. 9 of the German Civil Code (BGB) and Art. 59 para. 1 lit. n of the Italian Consumer Code).
3. Rates & Payment Conditions
All rates exclude the applicable tourist tax (Imposta di Soggiorno) levied by the Municipality of Toscolano Maderno. A minimum stay of 2 nights applies as a general rule; during the high season (the months of July and August), a minimum stay of 5 nights is required. The tourist tax is a statutory requirement, and its collection by the landlord is a legal obligation; it must be paid separately in cash on the first day of arrival. The contractual payment deadlines (deposit and final balance payment) are determined by the conditions selected and confirmed during the booking process.
4. Final Cleaning & Guest Services
We operate holiday accommodation rentals on a self-catering basis. No automatic interim cleaning or daily hotel services are provided during your stay. The costs for the mandatory final cleaning are displayed transparently during the booking process and are included in the total price. They are as follows: Double Rooms (“Sanico” and “Ortello”): a one-off fee of €25 Apartments (“Pizzocolo” and “Maderno”): a one-off fee of €50 Should you request an additional interim service (interim cleaning including a full change of bed linen and towels) during your stay, these flat fees will be charged again per requested cleaning.
5. Cancellation Policy
Cancellations must be submitted in writing via email to alpina-sanico@libero.it. Unless otherwise agreed upon via the booking portal, the following standard cancellation fees apply, which already take into account any saved expenses on our part:
- Up to 30 days prior to arrival: In the event of a cancellation up to 30 days before check-in, we will retain the deposit paid (30%) as a processing and cancellation fee.
- Less than 30 days prior to arrival / No-Show: In the event of a short-notice cancellation (less than 30 days prior to arrival) or a failure to arrive, 90% of the total booking amount will be charged. The guest retains the right to prove that the landlord suffered no damage or a significantly lower damage than the flat fee. We highly recommend purchasing a travel cancellation insurance policy.
6. Traveling with Pets (Dogs)
Dogs are warmly welcome subject to prior notice. Due to the increased deep-cleaning effort required, a one-off surcharge of €20 will be charged if you are accompanied by a dog. The guest is fully liable for any personal injury, property damage, or financial loss caused by the animal to the furnishings, the building, or the private property. In all communal areas, stairwells, and on the property grounds, dogs must strictly be kept on a leash at all times.
7. Statutory Registration Requirements (Italy)
Under Italian law, the guest is legally required to provide the personal data and identification details of all traveling party members needed for the mandatory police notification (Alloggiati Web / Questura). This data must be provided digitally in advance or immediately upon arrival at the latest. Without these details, accommodation cannot legally be granted in Italy; no right to a refund of the rental price exists in such cases.
8. Liability & Guest Obligations
The guest is obliged to treat the accommodation, the building, and the inventory with the utmost care. Any damages must be reported to the landlord immediately. The guest is liable for all damages caused by themselves or their fellow travelers. The landlord assumes no liability for damages or service disruptions caused by force majeure (e.g., extreme weather conditions, official government restrictions, or unpreventable power or water outages not caused by the landlord).
9. Miscellaneous, Applicable Law & Jurisdiction
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The contract is governed by the laws of the country in which the respective landlord has their primary residence (German law applies to the apartments, Italian law applies to the double rooms). In accordance with mandatory consumer protection laws, for any disputes arising from this contract, the exclusive place of jurisdiction shall be the court of the place where the consumer (guest) has their habitual residence or domicile. Mandatory consumer protection rights of the guest's home country remain otherwise unaffected by this choice of law.
10. Online Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
